Adrian is a partner with Dentons Canada LLP. Adrian acts for employers in occupational health and safety and employment matters. He represents companies charged with health and safety offences and provides strategic advice through the Ministry of Labour investigation process. He has been successful in having safety charges dismissed, stayed for delay and withdrawn by the Ministry of Labour. Adrian served for four years as an adjunct professor of Employment Law at the Faculty of Law, University of Western Ontario. He is the author of three books and regularly speaks on OHS and employment law topics.

Lindsay is the head of Dentons' Calgary Employment/Labour practice group. She has practised for over 15 years and maintains a focus in the areas of litigation, employment law and occupational health and safety, primarily representing corporate clients. Lindsay regularly provides clients with solid risk analysis and strategic advice for handling issues and disputes. She has had involvement in a number of high profile cases and is experienced in dealing with the media.

Dentons’ Construction | Infrastructure Group advises on project development, contracting strategy, alliance agreements, awarding of contracts, health and safety programs and private-public partnerships, as well as develops contracts for all types of construction and procurement methods.

Recent Matters

Defence of Occupational Health and Safety Charges

Represented numerous employers charged with offences under occupational health and safety legislation.

Accident Response and Investigations

Advised employers on accident response strategy, including requests by government inspectors for witness statements, and production of investigation reports.

Legislative Compliance and Risk Management

Provided advice and opinions regarding compliance with occupational health and safety laws. Assisted with the implementation or improvement of occupational health and safety and workers’ compensation programs.

Workplace Violence and Harassment

Advised employers on conducting workplace violence risk assessments and preparing and implementing workplace violence prevention policies. Advised on implications of Ontario Bill 168.

Project Safety Planning: Constructors and Prime Contractors

Provided advice regarding safety duties on construction projects including identification of “constructor” / “prime contractor” and delegation of management of “prime contractor” in those jurisdictions where prime contractor can be delegated.

Compliance Orders

Advising employers regarding response to compliance orders and representing employers in appeals of compliance orders.

Workers’ Compensation Representation

Represented employers in appeals under workers’ compensation / workplace safety and insurance legislation.

Safety Policies and Procedures

Drafted safety policies and procedures, including those on workplace violence.
